NAR ANNOUNCES PROPOSED SETTLEMENT AGREEMENT TO RESOLVE NATIONWIDE HOMEBUYER CLAIMS IN TUCCORI CASE

Message from MIAMI REALTORS®:

Today, April 10, 2026, the National Association of REALTORS® (“NAR”) announced a settlement agreement in Tuccori et al. v. At World Properties et al., a class-action antitrust lawsuit related to buyer-agent commissions.

NAR was not a named defendant in Tuccori. NAR stated in their FAQs that they “elected to participate to secure a comprehensive resolution to these homebuyer claims”. NAR further published that this proposed settlement is intended to release the claims in Batton et al. v. National Association of REALTORS® et. al.— a similar homebuyer antitrust lawsuit where NAR is a named defendant.

WHAT THIS MEANS FOR YOU:

  • NAR FAQ #6 , states that this settlement does not require any additional changes to business practices.
  • The proposed settlement is still subject to court approval.
  • The settlement agreement is not available or posted online. If and when it is, the MIAMI REALTORS® Legal Department will let you know.
  • According to NAR FAQ #28, the proposed Tuccori settlement releases ALL REALTOR® members from liability who comply with NAR rules and policies, unless they previously settled or have been named in similar homebuyer litigation.
  • More specifically NAR FAQ #25 states that the Tuccori settlement releases the following from liability: REALTOR® members (that’s you!); state and local REALTOR® associations (such as MIAMI) (including those that do, and do not operate MLSs); REALTOR® MLSs; non-REALTOR® MLSs; and, certain real estate brokerages with a REALTOR® as principal that “have not previously settled or been named in similar litigation and meet specified eligibility criteria, including compliance with NAR rules and policies and not asserting claims contrary to the settlement”.
    • NAR has not yet released details regarding eligibility and coverage for the release of liability. But details will be provided through the formal settlement process.
  • NAR FAQ #18 reports that because the claims made in Batton are similar to those made in Tuccori, the “settlement in Tuccori is intended to release the claims in the Batton case.”
  • Lastly, NAR FAQ #15 addresses member dues. NAR does not expect to change membership dues.
