CORONAVIRUS FAQ
Through the CARES Act, unemployment benefits in Florida have been expanded to self-employed individuals and independent contractors. Apply for benefits at www.FloridaJobs.org/RAApplication. Before doing so, make sure that you read through the Department of Economic Opportunity’s guidance HERE.

CONDOMINIUM, COOPERATIVE, AND HOMEOWNER ASSOCIATIONS
As you know, your MIAMI Government Affairs and Legal teams have been working diligently with the Department of Business and Professional Regulation (DBPR) to ensure the passage of DBPR Emergency Order 20-06. As of June 1, 2020, the DBPR is no longer allowing condominium, cooperative, or homeowner associations to use their emergency powers for COVID-19 related issues.
Moreover, in our conversations with the DBPR, which are reflected in EO 20-06, Fla. Stat. Sec. 718.1265(g) only applies to physical damage to the building. If associations continue to block your access to show units, please take these steps:
STEP #1: Ask where the association has the authority to block your access when the owners of the units have invited you and have given you permission to be there. Confirm this in writing with the association.
STEP #2: File a complaint with the DBPR against the association(s). You can find the complaint form and instructions HERE.

Florida Governor Ron DeSantis issued Executive Order No. 20-137, which extends the moratorium on all residential evictions for non-payment of rent and foreclosures until 12:01 AM on July 1, 2020. The CARES Act moratorium on evictions from buildings with federal loans expires on July 25, 2020.
Make sure that you are also checking with your local county courts about whether there are additional requirements and forms that you must follow when filing evictions.

WHAT TO DO ABOUT ASSOCIATIONS THAT CONTINUE TO DENY ACCESS

As of June 5, 2020, all of Florida except for Miami-Dade, Broward, and Palm Beach Counties are now in Phase 2 of Governor Ron DeSantis’ Safe. Smart. Step-by-Step. Plan for Florida’s Recovery (the “Plan”). Vacation rentals are now allowed in Phase 2 with certain restrictions (see pp. 25-26 of the Plan). Otherwise, according to , Executive Order 20-123, Miami-Dade, Broward, and Palm Beach Counties have to seek approval from the Governor to operate vacation rentals.

- NEW FORM: COVID-19 / Coronavirus In-Person Acknowledgement on Form Simplicity. Florida Realtors released a form on April 13, 2020, that Realtors can provide to consumers who still wish to view or show properties in person. It can be given to sellers, landlords, potential buyers, and potential tenants by the listing office, the cooperating office, or both.
