Ethics Complaint
Please remove everything under the Ethics Complaint section and add the following:
If you feel that a REALTOR® member of MIAMI Association of REALTORS® has violated any of the Article(s) of the National Association of REALTORS® Code of Ethics, or the MIAMI REALTORS®’ bylaws, you can file an ethics complaint.
However, before doing so, you will need to go through the Ombudsman Process. It’s a confidential process where one of our volunteer members attempts to informally resolve the issue between you and the REALTOR® member of MIAMI REALTORS®.

If that is not successful, we send you the link to file an ethics complaint online. Please remember that ethics complaints are ONLY for alleged violations of one or more Articles of the National Association of REALTORS® Code of Ethics and/or MIAMI REALTORS®’ Bylaws.
In the meantime, please remember that while the Association cannot provide advice or discuss the facts of your case, we can answer any procedural questions you may have. We also highly encourage you to familiarize yourself with the Professional Standards resource page HERE. In part, it includes the NAR Code of Ethics and Arbitration Manual, as adopted by the Board, which is what the Association adheres to in ethics and arbitration cases.

Arbitration Request
Requests for arbitration must arise out of a contractual dispute, involving money, related to a real estate transaction that has already closed.
If you have a dispute that involves money with a seller/owner, a landlord/tenant, or with your own broker/agent, this is likely not an arbitrable issue with MIAMI REALTORS®.
Requests for arbitration MUST be filed by the Designated REALTOR® or REALTOR® Principal for your brokerage (“complainant”) against the other Designated REALTOR®, REALTOR® Principal, and/or the brokerage (“respondent(s)”). If you are unsure of who this is, you can research the licensee on DBPR’s website and the brokerage on Sunbiz.
Please bookmark the Professional Standards Resources website. Of note is the NAR Code of Ethics and Arbitration Manual, as adopted by the Board, which are the rules and procedures that MIAMI REALTORS® adheres to in arbitration cases.
STEPS TO FILE A REQUEST FOR ARBITRATION:
- File your Request for Arbitration online. You must also upload all supporting documentation online.
- Mail a check for $500, payable to the MIAMI Association of REALTORS®, to the attention of Xochitl Rieche at 1800 Oakwood Drive, Miami, Fl 33166.
- Please click HERE to sign and return the forms (Request for Mediation, Agreement to Mediate, and Mediation Officer Selection Form).
- Please click HERE to sign and return the forms (Request and Agreement to Arbitrate).
WHAT TO EXPECT NEXT:
- At the Grievance Committee’s next scheduled meeting, the members will review your Request for Arbitration.
- You will be notified of the Grievance Committee’s decision. If the Grievance Committee decides to forward your Request for Arbitration to a hearing, the next step will be mediation. If the Grievance Committee declines your Request for Arbitration, you will be notified of the reasons.
- Professional Standards cannot give you an estimate of when the mediation and/or hearing will be scheduled. Proceedings are scheduled based on the availability of our volunteer members. We are not able to accommodate schedule requests.
- MAKE SURE YOU ADD CASEPRO@MIAMIRE.COM AND PROFESSIONALSTANDARDS@MIAMIRE.COM TO YOUR SAFE SENDERS LIST! All notices and case updates will be sent via email.
