Legal Alert: New Wave of Potential Fair Housing Cases

Our members and Florida Realtors have alerted us to the overwhelming number of demand letters (which include draft complaints that have not been filed) alleging that your websites fail to provide accessibility options for individuals with disabilities. These allegations are based on the Federal and Florida Fair Housing Acts – not the Americans with Disabilities Act (ADA).

While the actual complaints have not been filed in federal court at this point, the demand letters threaten legal action and should not be ignored. Florida Realtors will be releasing an alert very soon. In the meantime, immediately take these steps if you receive one of these demand letters:

  • STEP #1: Contact your broker.
  • STEP #2: Contact your attorney and/or the Florida Realtors Legal Hotline at (407) 438-1409.
  • STEP #3: Fix your website or take it down.
