Understanding who owns what is the key to creating a good estate plan. Even the most sophisticated and well-thought-out plan will fail if you don’t understand how the property is titled. It might pass directly to beneficiaries by operation of law, or it might require probate. Property is either a probate asset or a non-probate asset, depending on how ownership is held.
Probate is the court-supervised legal procedure that ensures the proper people are given the rights to and responsibility for the decedent’s financial and physical assets. Many legal aspects of the probate process—such as filing the initial and closing petitions—will be handled by your probate attorney.
This course includes the following material:
- Implications of real estate holdings upon death for both domestic and international clients
- The Probate process and the disposition of property
- Tax consequences for an Estate
- Strategies to use Family Partnerships, Revocable and Irrevocable Trusts as financial tools to reduce tax liability and avoid Probate expense.
- The benefits of gift planning
- Strategies to use offshore corporations and trusts for international clients
